Understanding the SCRA and Your Rights
The purpose of the Servicemembers Civil Relief Act is to provide temporary relief from pressing judicial and administrative proceedings while a service member is performing their military duties. Without protection through this legislation, a service member can find their civil rights adversely affected.
Because of the military backgrounds of the attorneys at PGD Law PLLC, we are well-versed in the SCRA and understand the protections it affords service members. If you choose to retain our services, we will explain the steps you need to take after receiving a notice of a civil proceeding and the timeline in which you need to take action.
Requesting a Stay Under the SCRA
The SCRA lists a number of civil proceedings for which it provides protection. The SCRA is an incredibly valuable tool when facing civil proceedings, especially to married service members going through divorce proceedings or child custody disputes.
Under the SCRA, a service member who is in a period of active service — or in some cases, after service has ended — and has received a notice of civil proceedings, that service member may request a 90-day stay of legal proceedings from the court. In certain circumstances, this stay may be extended by a judge.
