What are different military benefits?

Understanding military benefits is an important part of understanding the military property division process during divorce. Answering questions about what military benefits include will help divorcing military couples anticipate how some of these concerns will be addressed during the property division process.

Military members receive benefits for housing, groceries and healthcare. Benefits are in addition to the military pay the military member receives which may include special pay and allowances for pay grade, military job and deployment. Married service members also receive Basic Allowance for Subsistence (BAS) and Basic Allowance for Housing (BAH).

Basic Allowance for Housing is for active duty service members and is received as part of their bi-weekly pay. Military families also receive military shopping benefits and healthcare benefits. Additional benefits may also be available to military families. Not all benefits may be part of the property division process during the military divorce but it is helpful for divorcing spouses to be familiar with that process. Military pension and other important, and sometimes complicated, considerations can also come into play.

Property division in a military divorce will be conducted according to the property division rules in the state such as equitable property division which will focus on achieving a fair division of property. Equitable property division does not necessarily mean property will be divided in half and as part of developing a fair property division settlement agreement, divorcing couples of encouraged to work together whenever possible. Overall, it is important for divorcing couples to be aware of and familiar with this process.
